The postponement of a hearing to place 37 dogs seized last week could mean the animals will be returned to their owners, who have been charged with animal cruelty in the case. “I’m concerned, and the SPCA was upset (that the hearing) had been moved,” Upshur County Pct. 1 Constable Gene Dolle said Thursday. “They were all ready with their attorney and veterinarian to come from Dallas for the hearing.” Dolle’s concern stems from a Texas Health and Safety Code statute that states, “The court or magistrate shall issue the warrant and set a time within 10 calendar days of the date of issuance for a hearing in the appropriate justice court or municipal court to determine whether the animal has...
